Last updated: 20 October 2026

Overview

Welcome to Cellspot.

Cellspot is an online retail store operated by Online Offers (Pty) Ltd, a company registered in the Republic of South Africa.

Throughout these Terms of Service, references to "Cellspot", "we", "us" and "our" mean Online Offers (Pty) Ltd, trading as Cellspot.

We operate the website https://cellspot.co.za, offering mobile phones, accessories and other electronic products to customers throughout South Africa.

Our ecommerce platform is powered by Shopify.

These Terms of Service govern your access to and use of our website, products and related services.

By using our website or placing an order, you agree to these Terms of Service, subject to your rights under applicable South African law.

Nothing in these Terms limits or excludes any rights that cannot lawfully be waived under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable legislation.

1. Access and Customer Accounts

Customers must provide accurate and complete information when placing orders or creating accounts.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree not to use our website for unlawful, fraudulent or unauthorised purposes.

Where a person is not legally competent to enter into a purchase agreement independently, the necessary consent or assistance of a parent or legal guardian is required.

Cellspot may suspend or restrict access to accounts where there is reasonable evidence of fraud, misuse or unlawful activity.

2. Products and Product Information

Cellspot sells mobile phones, accessories and other electronic products.

We make reasonable efforts to ensure that product descriptions, specifications, photographs, pricing and availability are accurate.

Product photographs may be illustrative. Colours and appearance may vary slightly depending on screen settings and manufacturer specifications.

The specifications and features stated in the relevant product listing form part of the information on which customers may rely when making purchasing decisions.

Where a material error is identified, Cellspot will take reasonable steps to correct it and notify affected customers.

Product availability is subject to stock levels and order confirmation.

Cellspot reserves the right to discontinue products or limit quantities, subject to applicable law and orders already accepted.

3. Orders and Order Acceptance

Placing an order constitutes an offer to purchase the selected products at the displayed price and applicable delivery charge.

Orders are subject to stock availability, successful payment processing and reasonable verification procedures.

An automated order acknowledgement confirms that an order has been received but does not necessarily constitute final acceptance.

Cellspot will communicate order acceptance or fulfilment confirmation to the customer.

If an order cannot be accepted or fulfilled, we will notify the customer and refund any amount paid in accordance with applicable law.

We may request additional verification where reasonably necessary to prevent fraudulent transactions.

Customers should review their order details, delivery address and contact information before completing checkout.

Statutory cancellation and return rights remain applicable regardless of the order acceptance process.

4. Prices, VAT and Billing

All product prices displayed on the Cellspot website are quoted in South African Rand (ZAR) and include Value Added Tax (VAT) at the applicable South African rate, unless expressly stated otherwise.

Cellspot is operated by Online Offers (Pty) Ltd, a VAT-registered South African company.

Delivery charges, where applicable, are calculated separately and displayed during checkout before the customer confirms the purchase.

The total payable amount will be presented before payment is authorised.

Prices and promotions may change without notice, but changes will not affect orders already accepted, except as permitted by law.

Cellspot will provide VAT-compliant tax invoices in accordance with applicable South African tax requirements.

Customers must provide accurate billing and contact information.

If a pricing or billing error is identified, we will contact the customer and resolve the matter in accordance with applicable consumer legislation.

5. Payments

Payments are processed through payment service providers made available at checkout.

Available payment methods may include debit cards, credit cards and other approved electronic payment options.

The payment methods displayed at checkout will determine which options are available for a particular transaction.

Cellspot does not require customers to provide payment card details by email.

Payment transactions may be subject to fraud prevention and verification procedures.

Orders will generally be processed once payment has been successfully confirmed.

Where a payment is reversed, declined or identified as potentially fraudulent, Cellspot may suspend fulfilment while the transaction is investigated, subject to applicable law.

6. Shipping and Delivery

Cellspot offers courier delivery to physical addresses throughout South Africa.

Orders are dispatched from stock held or controlled by Cellspot using third-party courier services.

Delivery charges are displayed at checkout before payment.

Estimated delivery times depend on destination, stock availability, order verification and courier operations.

Delivery estimates are not guarantees, but Cellspot remains responsible for complying with applicable statutory delivery obligations.

Cellspot remains responsible for goods during delivery to the extent required by South African consumer law. The mere handover of goods to a courier does not automatically transfer statutory delivery risk to the customer.

Customers must provide accurate delivery information and reasonable assistance necessary to complete delivery.

If a parcel is delayed, damaged, missing or incorrectly delivered, customers should contact support@cellspot.co.za.

Further information is available in our Shipping & Delivery Policy.

7. Returns, Refunds and Cancellations

Returns, refunds, exchanges and order cancellations are governed by our Returns & Refunds Policy and applicable South African legislation.

Where the Electronic Communications and Transactions Act provides a statutory cooling-off right, customers may exercise that right within the applicable period and subject to any lawful exceptions.

Other statutory cancellation rights may also apply, depending on the circumstances.

Where a refund is legally due, Cellspot will process it within the applicable statutory timeframe.

Customers should contact support@cellspot.co.za before returning a product so that the appropriate return arrangements can be made.

Nothing in our policies limits statutory remedies available to consumers.

8. Defective Products and Warranties

Cellspot is the customer's primary point of contact for defective products, warranty enquiries and after-sales support.

Customers experiencing a fault should contact support@cellspot.co.za with their order number and details of the problem.

Where appropriate, Cellspot will arrange for the device to be returned and coordinate technical assessment with the relevant supplier or manufacturer.

Supplier involvement in the assessment or repair process does not remove Cellspot's obligations as the retailer.

Customers retain their rights under the Consumer Protection Act, including the statutory implied warranty of quality and the remedies available for qualifying defective or unsafe goods.

In particular, the Consumer Protection Act provides remedies for qualifying defects arising within six months of delivery, subject to its provisions.

Manufacturer or supplier warranties may provide additional protection beyond statutory rights.

No warranty condition in these Terms excludes or restricts rights that cannot lawfully be excluded.

9. Customer Responsibilities

Customers agree to use products in accordance with applicable instructions and safety guidelines.

Customers should retain relevant proof of purchase and any documentation supplied with the product.

Before returning a cellphone for technical assessment, customers are encouraged, where possible, to back up personal information and remove personal accounts, SIM cards and memory cards.

Cellspot will take reasonable measures to protect personal information handled during a return or repair, in accordance with applicable privacy legislation.

Customers remain entitled to statutory remedies notwithstanding ordinary product-use responsibilities.

10. Intellectual Property

The Cellspot website, including its original text, branding, graphics, design and other protected content, is owned by or licensed to Cellspot, except where otherwise indicated.

Product trademarks, photographs, specifications and manufacturer branding may belong to their respective owners.

Nothing in these Terms transfers ownership of third-party intellectual property to Cellspot or to customers.

Website content may not be reproduced or commercially exploited without the relevant rights holder's permission, except as permitted by law.

11. Third-Party Services and Tools

Our website may use third-party services for ecommerce hosting, payment processing, courier delivery, analytics and customer communications.

These providers may operate under their own terms and privacy policies.

Cellspot remains responsible for its own contractual and statutory obligations to customers.

We are not responsible for independent third-party websites that customers choose to visit through external links, except where applicable law provides otherwise.

12. Shopify Platform

Cellspot uses Shopify to operate its online store.

Shopify provides the ecommerce technology supporting product listings, shopping carts, checkout and related services.

Purchases made through Cellspot are transactions between the customer and Online Offers (Pty) Ltd, trading as Cellspot.

Shopify is not the seller of Cellspot products.

13. Privacy and Personal Information

Cellspot processes personal information in accordance with its Privacy Policy and applicable South African data protection legislation, including the Protection of Personal Information Act (POPIA).

Personal information may be processed for legitimate purposes such as fulfilling orders, processing payments, arranging deliveries, preventing fraud and providing customer support.

Relevant information may be shared with authorised service providers where necessary for these purposes and subject to applicable legal requirements.

Marketing communications will be handled in accordance with applicable consent and direct-marketing requirements.

Customers may contact support@cellspot.co.za regarding privacy enquiries.

Our Privacy Policy provides further information.

14. Customer Feedback and Reviews

Customers may submit product reviews, suggestions or feedback through channels made available by Cellspot.

By submitting content for publication, customers grant Cellspot a non-exclusive permission to use and display that content for legitimate business purposes, subject to applicable law.

Customers must not submit unlawful, defamatory, misleading or infringing content.

Cellspot may moderate or remove content where reasonably necessary and lawful.

Personal information contained in feedback will be handled in accordance with our Privacy Policy.

15. Errors and Inaccuracies

Occasionally, product listings or website information may contain errors relating to pricing, descriptions, availability or promotions.

Cellspot reserves the right to correct errors and update information.

Where an error affects an order, we will communicate with the customer and resolve the matter in accordance with applicable law.

Any cancellation of an accepted order and any resulting refund will be handled subject to the customer's statutory rights.

16. Prohibited Uses

Customers may not use the website to:

  • Commit fraud or engage in unlawful activities.

  • Misrepresent identity or payment information.

  • Introduce malicious software or interfere with website security.

  • Access another customer's account without authorisation.

  • Infringe intellectual property rights.

  • Collect personal information unlawfully.

  • Disrupt or misuse the website or its supporting systems.

Cellspot may take reasonable action to prevent misuse, including restricting access where justified.

Lawful browsing, accessibility tools and legitimate automated access are not prohibited merely because they use automated technology, provided they comply with applicable law and reasonable security requirements.

17. Availability of Website Services

We aim to keep the Cellspot website accessible and functioning correctly.

However, temporary interruptions may occur due to maintenance, technical faults, network outages or events outside our reasonable control.

Cellspot does not guarantee uninterrupted website availability.

This provision does not exclude liability or remedies that cannot lawfully be excluded.

18. Liability and Consumer Rights

Cellspot will exercise reasonable care in operating its website, processing orders and fulfilling its obligations.

To the extent permitted by applicable law, Cellspot is not liable for losses caused solely by circumstances beyond its reasonable control or by a customer's unlawful misuse of the website.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under mandatory consumer protection legislation.

No provision removes a customer's statutory rights relating to defective products, unsafe goods, delivery obligations, refunds or other legally protected remedies.

Any limitation of liability applies only to the extent permitted by South African law.

19. Indemnification

Customers are responsible for losses directly caused by their unlawful conduct, fraud or material breach of these Terms, to the extent permitted by law.

Nothing in this section requires customers to indemnify Cellspot for Cellspot's own unlawful conduct, negligence or failure to meet mandatory statutory obligations.

20. Termination or Restriction of Access

Cellspot may suspend or restrict access to the website or customer accounts where reasonably necessary to address fraud, security risks, unlawful conduct or material misuse.

Such action will not automatically cancel valid customer orders or remove statutory consumer rights.

Where an order is affected, Cellspot will communicate the appropriate resolution.

21. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed to the extent necessary.

The remaining provisions will continue to apply, provided they remain lawful and enforceable.

Mandatory consumer rights will prevail over any conflicting provision.

22. Entire Agreement

These Terms, together with the policies expressly incorporated into them and the applicable order information, form part of the agreement governing purchases through Cellspot.

Nothing in this section excludes representations, disclosures or rights that must be recognised under applicable South African law.

23. Assignment

Cellspot may transfer its rights or obligations where legally permitted, provided such transfer does not unlawfully prejudice customers' rights.

Customers may not transfer contractual obligations to another party without appropriate consent where such consent is legally required.

24. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be addressed in accordance with applicable South African law.

Customers may contact Cellspot directly to seek resolution of complaints.

Nothing in these Terms prevents a customer from approaching a competent court, the National Consumer Commission, an applicable consumer ombud or another authority with jurisdiction.

25. Electronic Communications

By placing an order, customers agree to receive electronic communications reasonably necessary for the transaction, including order confirmations, invoices, payment notifications, delivery updates and customer service messages.

Marketing communications are subject to applicable consent and direct-marketing requirements.

Customers are responsible for keeping their contact information reasonably up to date.

26. Changes to These Terms

Cellspot may update these Terms from time to time.

The current version will be published on our website.

Material changes will be communicated where required by law.

Changes will not retrospectively remove rights that customers acquired under previously accepted orders.
